# Terms of Service — DolceSong
## Overview
Welcome to DolceSong. The terms "we", "our" and "us" refer to DolceSong. DolceSong operates this website and online store, including all information, content, features, tools, products and related services (the "Services"), to provide an optimal shopping experience.
DolceSong is a Shopify-powered store, which provides the technical infrastructure enabling the Services.
These Terms of Service, together with all policies they refer to, set out the rights and obligations applicable to your use of the Services.
By accessing or using the Services, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not accept these Terms, you must not use the Services.
## Section 1 – Access and Account
By using the Services, you confirm that you have reached the legal age of majority in your jurisdiction of residence.
Access to certain Services may require you to provide personal information, including billing, payment and delivery details. You agree to provide accurate, complete and up-to-date information.
You are solely responsible for the confidentiality of your credentials and for all activity carried out through your account. Assigning, selling or transferring an account to a third party is strictly prohibited.
## Section 2 – Products (Our Songs)
Each DolceSong song is custom-made to the brief you provide. We strive to describe our styles, voices and samples as accurately as possible; however, because every song is a unique creative work, the final result may vary, and any samples are illustrative of a style rather than a guarantee of an identical outcome.
We do not guarantee that a song will meet personal expectations or specific uses not expressly stated in your brief — any adjustments are covered by our free revisions.
## Section 3 – Orders
Any order placed constitutes an offer to purchase. DolceSong reserves the right to accept, refuse or cancel an order at its sole discretion.
An order is considered accepted only after explicit confirmation and effective receipt of payment. When you place an order, you ask us to begin creating your personalised song.
Cancellation and refund terms are defined in our Refund Policy. Songs are intended for personal use and not for resale.
## Section 4 – Prices and Billing
Displayed prices may change at any time. The price charged is the one shown at the time you place your order.
Prices are shown in pounds sterling (£) and, where we are required to charge it, include UK VAT.
You agree to provide valid and up-to-date payment information.
## Section 5 – Delivery
Our songs are delivered digitally — by email and via a private online listening page. There is no physical shipping.
Delivery times (e.g. standard within 5 days, or express within 24 hours where selected) are estimates only. DolceSong cannot be held responsible for delays caused by incorrect contact details provided by you, email or spam filtering, or circumstances beyond our control.
## Section 6 – Intellectual Property & Your Licence
All content on the Services (text, images, logos, graphics, videos, trade marks, etc.) is the exclusive property of DolceSong or its partners and is protected by applicable intellectual-property laws. Any unauthorised reproduction, exploitation or use is strictly prohibited.
Your song: on full payment, we grant you a worldwide, perpetual licence to use your song for personal, non-commercial purposes (listening, sharing privately, playing at your event). Commercial use (e.g. broadcast, paid distribution or resale) requires our prior written permission.
## Section 7 – Optional Tools
The Services may include tools or features provided by third parties, offered "as is" and "as available", without warranty. Use of these tools is at your sole responsibility.
## Section 8 – Third-Party Links
The Services may contain links to websites operated by third parties. DolceSong has no control over these sites and accepts no responsibility for their content or practices.
## Section 9 – Relationship with Shopify
DolceSong is a Shopify-powered store. Sales and transactions are concluded exclusively between you and DolceSong. Shopify cannot be held responsible for the products, services or transactions made through the store.
## Section 10 – Privacy Policy
Your use of the Services is subject to our Privacy Policy as well as Shopify's privacy policy. By using the Services, you acknowledge that you have read them.
## Section 11 – Feedback
Any review, comment, suggestion or content you submit to DolceSong may be used freely, without any obligation of confidentiality or compensation, for commercial, marketing or promotional purposes. You warrant that you hold the necessary rights to the content you submit.
## Section 12 – Errors and Omissions
DolceSong reserves the right to correct any error, inaccuracy or omission, including after an order has been placed.
## Section 13 – Prohibited Uses
Any illegal, fraudulent or abusive use, or any use that infringes the rights of third parties, is strictly prohibited — including submitting content that is unlawful, hateful, defamatory or infringing. DolceSong reserves the right to suspend or terminate access to the Services in the event of a breach of these Terms.
## Section 14 – Termination
DolceSong may terminate access to the Services at any time, without notice. Provisions intended to survive termination will remain in effect.
## Section 15 – Disclaimer of Warranties
The Services and products are provided "as is" and "as available", to the extent permitted by applicable law. This does not affect your statutory rights as a consumer.
## Section 16 – Limitation of Liability
To the extent permitted by law, DolceSong shall not be liable for indirect, incidental or consequential damages arising from the use of the Services or products. Nothing limits liability that cannot be excluded by law. Our total liability for any order is limited to the amount you paid for that order.
## Section 17 – Indemnification
You agree to indemnify DolceSong against any claim arising from your use of the Services or your breach of these Terms.
## Section 18 – Severability
If any provision is found invalid or unenforceable, the remaining provisions remain fully in force.
## Section 19 – Entire Agreement
These Terms constitute the entire agreement between you and DolceSong.
## Section 20 – Assignment
DolceSong may assign its rights and obligations without restriction. You may not assign yours without prior written authorisation.
## Section 21 – Governing Law
These Terms are governed by the laws of England and Wales. If you are a consumer, you retain the benefit of the mandatory consumer-protection laws of your country of residence and may bring claims in the UK courts.

DolceSong reserves the right to modify these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
